Terms of Use

1. Purpose

These Terms of Use govern the conditions for accessing and using the services offered by Formwise (hereinafter "the Platform"), published by 1367 Studio, registered office at 11 Rue Étienne Henry Gouin, 13011 Marseille, registered under number 912 767 845 00015.

2. Acceptance

Use of the Platform implies full acceptance of these Terms by the user. If the user disagrees with all or part of the Terms, they must immediately stop using the services.

3. Access to services

Access to the Platform is reserved to users with a personal account, created via the registration form. The user agrees to provide accurate information when creating their account and to keep it up to date. Access may be temporarily suspended for technical reasons (maintenance, updates, security…).

4. User obligations

The user agrees to:
use the Platform in a legal, fair and non-fraudulent manner;
not attempt to access unauthorised data or features;
not disrupt or interrupt the proper operation of the services;
respect the rights of other users and applicable laws.
Any breach may result in the immediate suspension or deletion of the account, without notice or compensation.

5. Intellectual property

All content on the Platform (text, logos, graphics, videos, software, etc.) is the exclusive property of Formwise or subject to a right of use. Any reproduction, representation, distribution or exploitation, in whole or in part, without prior authorisation is strictly prohibited.

6. Personal data

Data collected via the Platform is processed in accordance with our Privacy Policy. Under the GDPR, the user has a right of access, rectification, objection and deletion of their data by contacting: formwisecontact@gmail.com.

7. Liability

The Platform is provided "as is". Formwise cannot be held liable for direct or indirect damages resulting from the use or impossibility of using the services.

8. Termination

The user may delete their account at any time. The publisher reserves the right to suspend or terminate any account in case of non-compliance with these Terms, without notice.

9. Changes to the Terms

Formwise reserves the right to amend these Terms at any time. The user will be informed of any update via the Platform. Continued use after modification implies acceptance.

10. Applicable law and jurisdiction

These Terms are governed by French law. In case of dispute, exclusive jurisdiction is granted to the courts of Marseille, unless otherwise required by law.

The Platform's liability shall in no case exceed an amount equivalent to two (2) months of fees actually paid by the user for the use of the services during the twelve (12) months preceding the event giving rise to the dispute.
