Terms of Service

These Terms of Service govern the use of the Formwise platform and the services offered by the publisher to its professional customers.

1. Term and renewal

The contract is concluded for an indefinite duration, with automatic monthly or quarterly renewal depending on the chosen plan. Each started period is owed in full.

2. Termination

The customer may terminate the contract at any time, with one (1) month's notice prior to the renewal date. Termination does not entitle the customer to a pro-rata refund unless otherwise stated in the contract.

3. Service availability (SLA)

The publisher commits to an average monthly availability of 95%, excluding planned maintenance or force majeure. In case of significant breach, a commercial credit may be considered as a goodwill gesture, without constituting an admission of liability.

4. Limitation of liability

The publisher's liability is capped, all causes combined, at an amount equivalent to the sums paid by the customer in the last twelve (12) months. No compensation will be due for indirect damages, loss of data or loss of revenue.

5. Ownership and right of use

The customer is granted only a personal, non-exclusive and non-transferable right to use the services. No intellectual property right is transferred. Any reproduction or reverse engineering attempt is strictly forbidden.

6. Data portability

The customer may request the export of their data at the end of the contract. This operation may be subject to specific billing depending on its complexity. Data is returned in a standard format (CSV, JSON, etc.).

7. Applicable law and jurisdiction

This contract is governed by French law. In case of dispute, the competent courts shall be those of the jurisdiction of Marseille.
